The America Invents Act, signed into law September 16, 2011, is arguably the most comprehensive change in the U.S. patent system since 1836. The law contains a number of phased patent law provisions with the latest “first inventor to file” provision becoming effective March 16, 2013. While this provision harmonizes U.S. patent law with the rest of the world it is a radical change from the first-to-invent paradigm that helped characterize U.S. patent law for the past two centuries.
